Legal Justification
Negotiated without a prior call for competition • The works, supplies or services can be provided only by a particular economic operator for the following reason: • absence of competition for technical reason Explanation: A procurement process has been undertaken and the award decision has been challenged. This has prevented final award and therefore requires a short term contract with the existing provider to ensure that there is a continuation of vital services for primary care settings (GP's and Pharmacy) whilst this challenge is resolved. The Authority believes competition is absent for the technical reasons outlined above and the potential for patient harm and disruption.
