Legal Justification
Royal United Hospitals Bath NHS Foundation Trust (referred to as RUH) intends to award a contract under regulation 32(2)(b)(ii), to Deep Green Energy (referred to as Deep Green) for the installation of a data centre with a peak IT load of 800kw. The objective for the RUH is to harness heat generated by the data centre and return it to the RUH ecosystem, making substantial savings in terms of cost and energy. Deep Green is supported by Octopus Energy Generation and has been backed by £200 million of capital funding to develop data centres in suitable facilities.Deep Green propose to install a modern data centre where IT infrastructure has a high cooling demand and thus generates ‘waste heat’. This heat would be captured and piped directly into the RUH heat network.In return for a twenty-year lease arrangement Green Heat would fund, install, maintain and manage the delivery of the data centre, resulting in the described heat generation. This would also include the funding of an electrical connection from the Distribution Network Operator (DNO).The award of this contract would result in the following benefits:1) The installation of a modern data centre which generates heat that can be pumped back into the RUH heat system.2) The achievement of key RUH targets relating to sustainability, including an annual carbon saving of 548tCO2e.3) A significant saving in annual energy costs. 4) Provide the RUH with the ability to introduce a modern technology using renewable energy initiatives, without capital or revenue outlay by the Trust. Not awarding this contract would result in a loss of funding to the Trust and a missed opportunity for fully funded heat decarbonisation. RUH has reviewed the benefits outlined above and Deep Green’s niche position in this market and have assessed that awarding this contract enables the Trust to satisfy an optimal combination of commercial, sustainability and social value targets.RUH will observe a 10-day standstill from the date of this notice before entering into a contract with Deep Green Energy.
