Legal Justification

This contract is being modified in accordance with Regulation 72.1.e of the Public Contract Regulations 2015. This modification is being published in the interests of transparency.Pre-procurement activities had to be paused when the Covid-19 pandemic reached the UK (in March 2020) and APHA scientists, key to the re-tender project, were mobilised to work on pandemic-related activities. In addition, the incumbent supplier (Prionics / ThermoFisher) was heavily involved in the response to the pandemic as a manufacturer of diagnostic test kits. In Nov / Dec 2020, APHA and Defra Group Commercial resources were stretched due to the impact of project delays (due to the pandemic), actioning Covid-19-related projects and priority projects required before the end of financial year. A final 1-year extension provides sufficient time to conduct a re-tender under the Restricted Procedure, which includes a sample testing period + a 9-month lead-in period to manufacture the quantities required.
